LocalNews Loubiere teenager fined $2700.00 for possession of cannabis and cocaine by: – September 19, 2011 Share Share Tweetcenter_img Photo credit: lazytechguys.comNineteen year old Evans Charles of Loubiere was this morning fined $2700.00 on two charges of possession of Cannabis and possession of Cocaine by Magistrate Evelina Baptiste at the Magistrate’s Court in Roseau.According to the facts presented to the Court by Police Prosecutor Sergeant Nicholas Bruno, the Defendant and two others were seen on the top porch of Francis Enterprises on Friday 16th September, 2011 at about 9:30pm when Constable Yankey B and other officers of the Drug Squad Task Force were on patrol.Constable Yankey B informed the Defendant that they were going to be searched for drugs and ammunition. While conducting the search on Mr Charles, the police officer found a clear ziploc plastic bag containing what appeared to be cannabis and asked him about his findings; to which he replied ‘a little weed I have my friend that give it to me.’Constable Yankey B continued his search and found two straws and contents which appeared to be cocaine. He again questioned the Defendant about his findings but the Defendant explained that the substance did not belong to him and that his friend had given it to him when he saw the officers approaching.The Defendant was transported to the Police Headquarters in Roseau where the contents were placed into evidence bags which he signed.Mr Charles offered no objection to the facts read by the Police Prosecutor when asked by Magistrate Baptiste.In making a plea in mitigation for himself, Mr Charles told the Court, “I admit that I had the cocaine on me. I admit that I smoke marijuana. I will not do it again.”Magistrate Baptiste told the Defendant that she hoped he was speaking the truth for the benefit of himself and his community.In sentencing the Defendant, Magistrate Baptiste told him that she had considered the fact that this is his first offence and that he pleaded guilty, however she must also consider the aggravating factors in this matter.The aggravating factors being the prevalence of this type of offenses and the destructive nature of the abuse of these kinds of drugs. She also lamented the fact that the prevalence of these offenses are affecting the fabric of society; how we behave and how we conduct ourselves.Magistrate Baptiste also told Mr Charles, while he claims that the cocaine did not belong to him this is not significant, as a responsible person would ask to see what he is being given before accepting it and therefore he must accept responsibility for his bad action.On the charge of possession of Cannabis he was sentenced to pay the sum of $700.00 on or before the 28th day of February, 2012 or in default spend five months imprisonment, and on the charge of possession of cocaine he was sentenced to pay the sum of $2000.00 on or before the said 28th day of February, 2012 or in default spend six months imprisonment.Dominica Vibes News 6 Views   no discussions Sharelast_img read more
